What guardianship or conservatorship is
- What it is called
Guardian (limited or unlimited) of an incapacitated person; emergency guardian; temporary substitute guardian; conservator (limited or unlimited) of a protected person's estate
- When a court may appoint one
An 'incapacitated person' cannot receive and evaluate information or make or communicate decisions to the extent they cannot meet essential requirements for physical health, safety or self-care, even with appropriate and reasonably available technological help. The court may appoint a guardian only if it finds by clear and convincing evidence that the person is incapacitated and their needs cannot be met by less restrictive means, and should grant only the powers needed. A conservator may be appointed if, by clear and convincing evidence, the person cannot manage property and business affairs effectively.

- Choosing your own
You can nominate a guardian or conservator of your estate or person in a power of attorney; the court must follow your most recent nomination except for good cause or disqualification. You can also nominate a guardian in a written advance health-care directive or mental health care directive. Your health care agent has priority for appointment as guardian.

If a guardian of your estate or other property fiduciary is appointed, your agent is accountable to them as well as to you, and the power of attorney continues unless the court limits, suspends or ends it. A guardian may not revoke your advance health-care directive without express court authority.
